abstract The so‐called ‘morning‐after pill’ is a drug that prevents pregnancy if taken no later than 72 hours after presumably fertile sexual intercourse. This article argues against a right of conscientious objection for pharmacists with regard to dispensing this drug. Some arguments that might be advanced in support of this right will be considered and rejected. Section 2 argues that from a philosophical point of view, the most relevant question is not whether the morning‐after pill prevents implantation nor is it (...) whether preventing implantation is tantamount to abortion. Section 3 suggests a more general philosophical question as most pertinent, namely whether and to what extent a pharmacist can justifiably be exempted from dispensing the morning‐after pill when to do so would entail participating in something that goes against his or her deepest moral or religious convictions. Section 4 explains why, within liberal institutions, pharmacists should not have the right to conscientious objection to dispensing the morning‐after pill. (shrink)

In the era of fake news, truth has become a different and more urgent political problem than the traditional issues of the arcana imperii and the lies of the rulers. Starting from this observation, and deepening some considerations contained in the essay by Hannah Arendt _Thruth and Politics_, the article offers a worried report on the possibility of truth (scientific and factual) not to be reduced to mere opinion among others, and concludes that only a loyal collaboration between epistemic authorities (...) and politics can make the judicial road for the protection of truth less attractive. L'antigiudaismo cristiano è essenzialmente la credenza che il popolo ebraico debba rinunciare alla propria fede e convertirsi al cristianesimo. In questo testo viene studiata la prima forma sistematica di antigiudaismo sviluppata in termini filosofici e teologici da Agostino d'Ippona. Alla luce dell'analisi filosofica sembra che l'avversione di Agostino per la fede ebraica si fondi su un'autentica rimozione della specificità del popolo eletto, della Legge e della Rivelazione sul Sinai.

Pero en la carta a Garve de 1798 afirma que aquello que lo despertó del sueño dogmático fue la Antinomia de la razón pura. El propósito de este artículo es ofrecer una interpretación de estos dos testimonios autobiográficos, que permita conciliarlos de manera coherente. Voy a sostener al respecto que am- bos despertares aluden a un mismo proceso, que comienza con la advertencia de Hume sobre el (...) problema de la causalidad, y se consuma con el tránsito al examen crítico de la razón, propiciado por el problema antinómico. Background The legitimacy of conscientious objection to abortion continues to fuel heated debate in Italy. In two recent decisions, the European Committee for Social Rights underlined that conscientious objection places safe, legal, and accessible care and services out of reach for most Italian women and that the measures that Italy has adopted to guarantee free access to abortion services are inadequate. Nevertheless, the Ministry of Health states that current Italian legislation, if appropriately applied, accommodates both the right to conscientious objection (...) and the right to voluntary abortion. Main body One empirical argument used to demonstrate that conscientious objection does not create barriers to abortion is the “no correlation” argument, which the Italian Committee for Bioethics employed to demonstrate that no association exists between conscientious objection and waiting times for voluntary abortion in Italy and to support the weak form of conventional comprise adopted by the Italian legislation to balance the conflict between women’ autonomy and healthcare professionals’ moral integrity. Conversely, we showed how the “no correlation” argument fails to demonstrate the absence of a relationship between the number of conscientious objectors and waiting times for voluntary abortion, and that the limitations of the “no correlation” argument itself demonstrate how it is still difficult to describe the real effect of conscientious objection on the access to abortion services and to evaluate the suitability of conventional compromise to effectively balance conflicting moral principles. Conclusion Further studies are needed to better describe the relationship between conscientious objection and waiting times for voluntary abortion. If new evidence would show that the increasing proportion of objectors does undermine the efficacy of the Italian law and the right of a woman to freely obtain a voluntary abortion, new ways will need to be found to address the conflict between moral principles and restrict the protection accorded to the principle of moral integrity. This would inevitably imply the need to constrain and to redefine the terms and conditions for claiming conscientious objection. (shrink)

What is the value of fictions, metaphors, figures and scenarios in adjudication? This book develops three models to help answer that question: inquiry, artefacts and imagination. -/- Legal language, it is argued, contains artefacts – forms that signal their own artifice and call upon us to do things with them. In this paper, I give a metaphilosophical analysis of the core idea of deflationism by discussing some basic conceptual and methodological issues involved in the debate between deflationism and substantivism. In so doing, I argue for three positive points. First, the crux of the dispute between deflationism and substantivism is whether or not truth is substantive in its metaphysical nature and in its explanatory role in philosophical enterprises, rather than whether or not a minimal approach regarding conceptual resources is taken (...) to explain truth; a minimal approach itself is philosophically innocent. Second, there is no intrinsic connection between the core idea of deflationism and the Tarski-style equivalence thesis, which is often identified as implying or supporting the former. Third, there are some unbridged fundamental gaps between the core idea of deflationism and various redundancy theses; these redundancy theses cannot be identified as the former, nor can they be used to justify the former on their own. Jin Yuelin 金嶽霖 was a Chinese philosopher and logician. From 1914 to 1920 he studied at the University of Pennsylvania and Columbia University, and received his Ph.D. in political science from Columbia in 1920. From 1921 until 1925, he studied in Europe and visited Great Britain, Germany, France, and Italy, among other countries. During these years, he studied at the London School of Economics and Political Sciences and at the University of Cambridge. At the end of 1925, Jin returned to (...) China and soon became a professor at Tsinghua University, where he began teaching logic in 1926. It is argued that the so‐called principles of “strong centering” and “weak centering” central to the traditional Lewis‐Stalnaker semantics for counterfactuals are both fallacious. A foundation for an alternative semantics without these prinsciples is outlined. The core idea is that the statistically normal worlds – rather than those worlds most qualitatively similar to the actual world – should serve as the semantical fulcrum.

After a brief review of the notions of necessity and a priority, this paper scrutinizes Kripke's arguments for supposedly contingent a priori propositions and necessary a posteriori propositions involving proper names, and reaches a negative conclusion, i.e. there are no such propositions, or at least the propositions Kripke gives as examples are not such propositions. All of us, including Kripke himself, still have to face the old question raised by Hume, i.e. how can we justify the necessity and universality of (...) general statements on the basis of sensory or empirical evidence? This article systematically challenges Kripke's modal argument and Soames's defence of this argument by arguing that, just like descriptions, names can take narrow or wide scopes over modalities, and that there is a big difference between the wide scope reading and the narrow scope reading of a modal sentence with a name. Its final conclusions are that all of Kripke's and Soames's arguments are untenable due to some fallacies or mistakes; names are not “rigid designators”; if there were rigid designators, (...) description(s) could be rigidified to refer fixedly to objects; so names cannot be distinguished in this way from the corresponding descriptions. A descriptivist account of names is still correct; and there is no justification for Kripke's theory of rigid designation and its consequences. (shrink)

Večina slikovnih koncepcij boleha za tem, da začenjajo previsoko, namreč na ravni slikovnih del in slikovnih medijev. Zaradi tega pri doživljanju slike nismo pozorni na razpoke in brezna. Ta očitek zadeva tako filozofske teorije slike kot tudi umetnostno teorijo, umetnostno zgodovino in muzejsko prakso, ki se ne zna več čuditi temu, da obstaja nekaj takega kot slike. Naslednji razmisleki se vrtijo okoli geneze slike, ki omogoča vdor v zaprtost nekega v lepi ali nič več lepi videz ujetega estetskega sveta, tako (...) da se sprostijo tako pred- kot tudi post-estetski motivi umetnosti. Umetnost terja genealogijo, ki bo enakovredna Nietzschejevi genealogiji morale ali Husserlovi genealogiji logike.The majority of pictorial conceptions are troubled by starting from too high a level, namely from the level of fine-art works and fine-art media. This is why we are likely to fail to notice crevices and chasms. This reproach is directed both at philosophical theories of the painting and at art theory, art history and museum practice, which is no longer able to express wonder at the sheer existence of the painting. The following reflections tackle the issue of the genesis of the painting, which enables us to penetrate into the closed sphere of the aesthetic world as caught in the beautiful, or no longer beautiful, appearance, and thereby sets free pre- as well as post-aesthetical motives of art. Art demands a genealogy on an equal stand with Nietzsche’s genealogy of morality or Husserl’s genealogy of logic. (shrink)

Although I do not have any final thoughts about the present topic, it might still be valuable to identify what questions are bothering many Chinese scholars. During an academic meeting last month Professor Yu Dunkang summarized the embarrassing situation confronting the study of Chinese philosophy today, as follows: "The object remains unclear, and the value is misplaced." The phrase "the object remains unclear" means that scholars are not sure what questions need to be studied in relation to what is called (...) "Chinese philosophy," while the phrase "the value is misplaced" means that scholars misunderstand the value and the meaning of their own work. To a large extent, this summary is correct; but the question is how this particular situation came into being. (shrink)

Plagiarism detection services are a powerful tool to help encourage academic integrity. Adoption of these services has proven to be controversial due to ethical concerns about students’ rights. Central to these concerns is the fact that most such systems make permanent archives of student work to be re-used in plagiarism detection. This computerization and automation of plagiarism detection is changing the relationships of trust and responsibility between students, educators, educational institutions, and private corporations. Educators must respect student privacy rights when (...) implementing such systems. Student work is personal information, not the property of the educator or institution. The student has the right to be fully informed about how plagiarism detection works, and the fact that their work will be permanently archived as a result. Furthermore, plagiarism detection should not be used if the permanent archiving of a student’s work may expose him or her to future harm. (shrink)
